Work Permit for Foreigners Married with Turkish Citizens

As you know, Turkey is one of the most important countries preferred by those who want to work and become investors from many countries of the world. It is a legal obligation for people who will work and become investor in Turkey to have a legal and valid work permit. As a rule, work permit applications are not made by the foreigner himself, but by the firm that will employ the foreigner. If there is no legal obstacle to the foreigner’s employment, foreigners can work legally in Turkey with the approval of the ministry and the delivery of the work permit card to the foreigner. In this article, we will share details about the work permits of foreigners married to Turkish citizens and the applicable regulation.

Special Exemptions for Companies

First of all, we would like to remind you that the company where a foreigner married to a Turkish citizen will work is exempt from some work permit concept. In companies that will employ a foreigner married to a Turkish citizen, the minimum paid-in capital requirement and the requirement to employ at least 5 insured Turkish personnel for each foreign personnel are not required. This situation provides a very important convenience especially for the foreign personnel needs of relatively small enterprises. Work permit applications made by the employer within the scope of exemption are evaluated by the Ministry of Labor. As a result of the evaluation, a work permit is given to foreigners whose application does not show any deficiencies/incompatibility.

Work Permit for Divorced Foreigners

One of the most important issues to be considered of regarding work permit exemptions for foreigners married to Turkish citizens is the requirement that the marriage be valid and made for the purpose of establishing a family union. If the marriage has ended before three years has passed, or if a formal marriage has been made other than for the purpose of establishing a family union, these work permits will lose their validity. If the marriage of foreigners with a Turkish citizen has ended at the end of three years, the work permits obtained by the foreigners can continue on the condition that they are legally present in Turkey. However, the final decision on this issue is made by the Ministry of Labor.
