Required Documents for Work Permit Application in Turkey

What are the required documents for work permit ?

For those who are not Turkish citizens and want to work in Turkey, the documents required during the application process vary according to the sector they want to work. Employers must provide appropriate documentations relevant to their business sector.

Documents to be provided by the employer for first application

  • Activity Certificate
  • Balance sheet and profit / loss statement approved by the tax authorities last year (scanned and upload online during electronic application)
  • The Turkish Trade Registry Gazette, which shows the latest capital and partnership structure (scanned and upload online during electronic application)
  • Electronic signature on behalf of authorized person for Social Security e-declaration
  • The payslip for Turkish citizens working in the same position for the institutions that want to employ foreign experts in the fields of engineering, construction, contracting and consultancy services and the contract between the foreign expert and employer.

Documents to be provided by first time applying foreigners

In addition to the documents above, foreigners who have been granted expertise in specific areas must submit the following documents:

  • Equivalence Regulations Obtained Abroad, sent in accordance with Articles 3 and 7/p of the law no. 2547 (uploaded online by scanning during electronic application), for applicants who have completed their higher education outside Turkey,
  • If deemed necessary for the Ministry, a copy of the degree of graduation or transcript of the temporary document and certified by a notary; For pilots, a pilot license from the country of origin (scanned and uploaded online during electronic application)
  • Copies of the labor contract in Turkish and the applicant’s mother tongue for Certified Tourism Companies have been translated into Recommendation Decree Turkish (scanned and uploaded online during electronic application)
  • In order to be employed in the education services that fall under the jurisdiction of the Ministry of National Education, proficiency certificates obtained from the same Ministry for foreigners. (Scanned and uploaded online during electronic application)

Applications made in accordance with the laws and regulations shall be finalized within 30 days by the Ministry of Labor and Social Security provided that all documents are complete. If the application is made outside Turkey, the result of the application for work will be sent to the Ministry of Foreign Affairs to inform the relevant Turkish mission. Work permits for “key personnel” in direct foreign investments considered significant investments at significant times are concluded within 30 days, provided that all documents are complete.

The work permit may be granted for a maximum period of 1 year (depending on the duration of the employment contract and economic conditions), provided that there are no substances contrary to the bilateral or unilateral agreement. The work permit may be extended for a period of 2 years provided that the foreign employee continues to work in the same workplace or in the same enterprise and profession. At the end of the 3-year total study period, the work permit can be extended for 3 years and the foreign employee can work with any employee which he/she wants.

A foreign individual may also obtain an indefinite period of work permit, provided that he/she has completed the legal and uninterrupted working period of 8 years in Turkey.
1. REQUIRED DOCUMENTS FOR WORK PERMIT FOR THE DOMESTIC APPLICATION

Documents required for foreign employee;

  • Employment Contract (signed by foreign and employer)
  • Passport Copy
  • Diploma Copy (Translated by sworn translator)
  • If appropriate, reference letter (translated by sworn translator)
  • Copy of the current Residence Permit for at least 6 months
  • Original work permit (for work permit extension application)

* As of 1 January 2015, passport validity is not allowed for entry to Turkey that is not longer than 60 days from the end date of the work permit.

Required documents for work permit by the employer;

  • Balance sheet and profit and loss statement of the previous year
  • Turkish Trade Registry Gazette containing the current capital of the organization and its affiliate structure
  • Activity certificate
  • Document that the company is not owed an unpaid tax (for work permit extension applications)

It should not be forgotten that the list above is complete, the Ministry of Labor and Social Security has the right to request other necessary documents in the evaluation process. Supporting documents may vary depending on the employer’s industry or the nature of the business.

2-REQUIRED DOCUMENTS FOR WORK PERMIT FOR ABROAD APPLICATIONS

Required documents for work permit to be provided by foreign employee;

  • Passport
  • Work permit application form
  • Employment contract or official job offer
  • An invitation letter addressed to the Turkish Consulate of foreigner’s homecountry
  • A photo
  • Diploma copy of foreigner (translated by sworn translator)
  • If necessary, foreign reference letter (translated by sworn translator)

Depending on the discretion of Turkish diplomatic representatives or bilateral agreements, some other supporting documents may be requested during the application process.

Required documents for work permit requested by the employer;
